Welcome to DaComedyZone.com (“DaComedyZone”, “we”, “us” or “our”).

These Terms & Conditions (“Terms”) govern your access to and use of DaComedyZone.com, including our website, memberships, subscriptions, comedy content, interactive tools, AI-powered features, credits, digital products and any other services we provide (collectively, the “Services”).

By accessing or using DaComedyZone.com, creating an account, purchasing credits or subscribing to a paid service, you agree to these Terms. If you do not agree with these Terms, please do not use our Services.

1. About DaComedyZone

DaComedyZone is an online comedy and entertainment platform providing content and features that may include:

• Jokes, memes and other comedy content;
• AI-powered joke, roast, pickup-line, meme and other comedy generators;
• Personalised comedy content;
• Daily jokes and email content;
• Free Comedy Crew membership;
• DaComedyZone+ premium membership;
• Credit-based features and services;
• Digital products;
• Competitions, promotions and special features;
• The DaComedyZone Comedy Crew characters and associated entertainment content; and
• Other comedy-related services introduced from time to time.

Our Services are intended primarily for entertainment purposes.

2. Eligibility

You must be at least 18 years old to purchase a DaComedyZone+ subscription, credits or other paid Services unless applicable law permits otherwise and any necessary parental or guardian consent has been obtained.

By purchasing a paid Service, you confirm that you are legally capable of entering into a binding contract.

Certain content on DaComedyZone may contain adult humour, sarcasm, roasts, relationship humour, mild offensive language or other material that may not be suitable for younger audiences.

3. Creating an Account

Some features require you to create a DaComedyZone account. You agree to:

• Provide accurate and current information;
• Keep your login details secure;
• Not share your account in a way that breaches these Terms;
• Notify us if you believe your account has been accessed without permission; and
• Accept responsibility for activity conducted through your account where legally appropriate.

We may suspend or restrict an account where we reasonably believe there has been fraud, misuse, unauthorised access or a material breach of these Terms.

4. Free Membership

DaComedyZone may offer free membership, currently referred to as the Comedy Crew, giving users access to selected content, tools, promotions and features.

Free features may be changed, added to or withdrawn from time to time. We do not guarantee that any particular feature offered free of charge will remain permanently available.

5. DaComedyZone+ Membership

DaComedyZone may offer a premium subscription service known as DaComedyZone+.

The features included with DaComedyZone+ will be displayed on the website before purchase and may include premium content, enhanced access to tools, personalised features, member benefits and other Services.

Prices will be clearly displayed before you complete your purchase. Where available, prices may be displayed in your local currency.

6. Subscription Payments and Automatic Renewal

Where you purchase a recurring DaComedyZone+ subscription, you authorise us and our payment provider to charge the applicable subscription fee using your selected payment method.

Unless clearly stated otherwise before purchase, recurring subscriptions will automatically renew at the applicable billing interval until cancelled. Before entering into a subscription, you will be shown key information including the price, billing frequency and applicable renewal and cancellation information.

Where required by applicable law, we will provide renewal or payment reminders and any applicable cooling-off information. Payments may be processed through third-party payment providers such as Stripe.

7. Cancelling a Subscription

You may cancel a recurring subscription in accordance with the cancellation options made available through DaComedyZone.

Where the subscription was entered into online, we intend to provide a straightforward online cancellation method.

Unless otherwise stated or required by law, cancelling prevents future renewal charges and you may continue using the paid Service until the end of your current paid billing period.

We will not deliberately make cancellation unnecessarily difficult. Nothing in these Terms limits any statutory cancellation or cooling-off rights you may have.

8. Free Trials and Promotional Subscription Offers

From time to time, DaComedyZone may offer free trials, introductory pricing, promotional subscriptions or other special offers.

The specific conditions of an offer, including its duration and what happens when the promotional period ends, will be explained before you sign up.

Where a free or discounted period automatically converts into a paid subscription, this will be clearly disclosed before you subscribe. Where required by law, we will provide appropriate reminders before applicable charges or renewals.

9. Cooling-Off and Consumer Rights

If you are a consumer, you may have statutory cancellation, cooling-off, refund and other rights depending on where you live and the type of Service purchased.

For UK consumers, certain online contracts may carry statutory cancellation rights. Different rules can apply where digital content or services begin immediately at the consumer's request.

Nothing in these Terms excludes or restricts any consumer rights that cannot legally be excluded or restricted.

10. Credits

DaComedyZone may operate a credit system that allows users to purchase credits and redeem them for eligible features or Services.

The number of credits required for a feature will be displayed where applicable. Credits:

• Have no cash value;
• Are not legal tender;
• Cannot normally be exchanged for cash;
• Cannot normally be transferred between accounts;
• May only be used for eligible DaComedyZone Services;
• Must not be resold without our permission; and
• May be subject to additional promotional conditions where provided free of charge.

Purchased credits will not expire arbitrarily where doing so would be unfair or contrary to applicable consumer law.

Any expiry conditions applicable to promotional or bonus credits will be clearly communicated.

Your statutory rights relating to purchased credits remain unaffected.

11. Prices

Prices for subscriptions, credits and other paid Services will be displayed before purchase.

DaComedyZone may offer different prices in different countries and currencies. We may change prices from time to time.

A change to the price of an existing recurring subscription will be communicated in advance where required, giving you an appropriate opportunity to cancel before the new price takes effect.

Prices include or exclude applicable taxes as stated at checkout and as required by law.

12. Refunds

Refund eligibility depends upon the product or Service purchased, the circumstances of the purchase and your applicable statutory rights. We may issue refunds where:

• Required by law;
• You were incorrectly charged;
• A technical problem materially prevented delivery of a purchased Service;
• An unauthorised transaction is established; or
• We otherwise determine that a refund is appropriate.

Nothing in this section limits statutory refund or consumer rights.

13. AI and Automated Comedy Tools

Some DaComedyZone Services may use artificial intelligence or automated systems to create jokes, roasts, memes, pickup lines, personalised content or other entertainment. AI-generated output can be unpredictable.

We do not guarantee that generated content will always be:

• Accurate;
• Original or unique;
• Appropriate for every audience;
• Error-free;
• Non-offensive;
• Suitable for a particular purpose; or
• Available without interruption.

Users should exercise judgment before publishing, sharing or relying upon generated content.

AI-generated content is provided primarily for entertainment purposes.

14. Roasts, Jokes and Offensive Content

Comedy is subjective.

DaComedyZone may contain sarcasm, satire, teasing, roasts, dark humour, relationship humour, adult humour and material that some users may find offensive. By using comedy-generation features, you acknowledge that generated results may occasionally be unexpected or provocative.

However, users must not intentionally use DaComedyZone to generate, request, publish or distribute content that is unlawful or otherwise prohibited by these Terms.

15. Acceptable Use

You must not use DaComedyZone to:

• Harass, stalk, threaten or intimidate another person;
• Promote hatred or unlawful discrimination;
• Exploit or sexualise minors;
• Facilitate criminal activity;
• Commit fraud or impersonate another person deceptively;
• Violate another person's privacy;
• Infringe intellectual property rights;
• Distribute malware or malicious code;
• Attempt to gain unauthorised access to our systems;
• Circumvent usage restrictions or security measures;
• Abuse automated tools or APIs;
• Scrape or systematically extract DaComedyZone content without permission;
• Resell our Services without authorisation; or
• Use the platform in any other unlawful manner.

We may restrict or terminate access where these rules are materially or repeatedly breached.

16. User Content

Users may be able to submit names, prompts, text, images, comments or other material (“User Content”). You retain any rights you already hold in your User Content.

You grant DaComedyZone a limited licence to process, reproduce and use User Content as reasonably necessary to operate, provide, secure and improve the requested Services, subject to our Privacy Policy and applicable law.

You must have the necessary rights or permission to submit User Content. You must not upload content that unlawfully infringes another person's intellectual property, privacy or other rights.

17. Sharing Generated Content

Subject to these Terms and any third-party rights, users may generally share comedy content generated for them through DaComedyZone for personal and social-media use. You are responsible for considering whether content is appropriate before sharing it publicly.

DaComedyZone does not accept responsibility for alterations, captions, context or additional material added by users after content has been generated or downloaded.

18. Intellectual Property

Unless otherwise stated, DaComedyZone and its licensors own or control the intellectual property rights in the DaComedyZone platform and original branded materials, including:

• DaComedyZone™
• DaComedyZone+™
• Comedy Crew branding
• Logos and visual identity
• Website design and original graphics
• Original branded comedy content
• Character designs, names, personalities and associated materials

including, where applicable: Zoe, Chuck, Dee, Nikki, Laughy, Roasty and Mickey.

You may not reproduce, sell, commercially exploit, imitate or create unauthorised merchandise using protected DaComedyZone intellectual property except where permitted by law or with our written permission.

19. Third-Party Services and Links

DaComedyZone may contain links to third-party websites, products, advertisers, affiliate offers, social platforms or services.

We are not responsible for third-party websites or services that we do not control. Their own terms and privacy policies may apply.

Where DaComedyZone receives an affiliate commission from a qualifying purchase, appropriate disclosures will be provided where required.

20. Advertising and Sponsored Content

Free areas of DaComedyZone may display advertising, sponsorships, affiliate promotions or other commercial content.

Sponsored or promotional content will be identified where required by applicable law.

21. Email Communications

If you register for daily jokes, newsletters, marketing communications or promotional updates, we may send those communications in accordance with your choices and our Privacy Policy.

You may unsubscribe from marketing emails using the unsubscribe facility provided. Service-related communications concerning your account, payments, security or subscription may still be sent where necessary.

22. Availability of the Service

We aim to keep DaComedyZone available and functioning reliably, but we cannot guarantee uninterrupted or error-free availability. We may temporarily restrict access for:

• Maintenance;
• Security;
• Technical problems;
• Service improvements;
• Legal requirements; or
• Circumstances reasonably beyond our control.

We may modify features as DaComedyZone develops, provided that doing so does not unlawfully deprive consumers of paid-for Services.

23. Suspension and Termination

We may suspend, restrict or terminate an account where reasonably necessary because of:

• Serious or repeated breaches of these Terms;
• Fraudulent activity;
• Abuse of the Services;
• Security risks;
• Unlawful activity; or
• Non-payment of applicable charges.

Where appropriate and reasonably possible, we may provide notice and an opportunity to remedy the issue.

Any statutory rights concerning prepaid Services remain unaffected.

24. Disclaimer

DaComedyZone is primarily an entertainment platform. Content available through the Services should not be treated as professional, medical, financial, legal, psychological or other specialist advice.

Comedy and AI-generated content should be interpreted accordingly.

25. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Subject to those protections, DaComedyZone will not be responsible for losses that were not reasonably foreseeable when the contract was entered into or losses resulting from circumstances outside our reasonable control.

If you use DaComedyZone as a consumer, these Terms do not exclude your statutory consumer rights.

26. Changes to These Terms

We may update these Terms where reasonably necessary, including because of:

• Changes to DaComedyZone;
• New Services or features;
• Changes in law or regulation;
• Security requirements; or
• Changes to our commercial arrangements.

The latest version will be published on DaComedyZone.com with an updated revision date.

Where a material change affects an existing paid subscription, we will provide notice where required by law.

27. Privacy

Our collection and use of personal information is governed by our Privacy Policy. Users should read the Privacy Policy alongside these Terms.

28. Cookies

DaComedyZone may use cookies and similar technologies in accordance with our Cookie Policy and applicable privacy law.

Where consent is legally required for non-essential cookies, users will be provided with appropriate choices.

29. Complaints and Contact
